1. Acceptance of terms

By creating an account or using Kind Health (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms form a legal agreement between you and Kind Health Ltd.

2. About the Service

Kind Health provides:

• AI-powered health guidance and triage (not medical advice)
• A marketplace connecting users with independent helpers, therapists, and care professionals
• A community forum for peer support
• Child care guidance resources

Kind Health is a technology platform. We are not a healthcare provider, and our AI does not provide medical diagnosis or replace professional medical judgment.

3. Eligibility

You must be at least 16 years old to create an account. By using the Service, you confirm that you meet this requirement. If you are adding a child profile, you must be the child's parent or legal guardian.

4. Account responsibilities

You are responsible for:

• Keeping your account credentials secure and confidential
• All activity that occurs under your account
• Providing accurate information in your profile
• Notifying us immediately of any unauthorised use at contact@kindnesscommunityfoundation.com

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, abuse, or harm other users or helpers
• Post false, misleading, or harmful health information
• Impersonate any person or entity
• Attempt to access other users' accounts or data
• Use the Service to provide medical diagnosis to others
• Scrape, crawl, or otherwise extract data from the platform

We reserve the right to suspend or terminate accounts that violate these rules.

6. Helpers and professionals

Helpers listed on Kind Health are independent third parties, not employees of Kind Health Ltd. We verify identities and credentials but are not responsible for the quality, safety, or legality of services they provide. Any agreement you enter into with a helper is directly between you and them.

Kind Health facilitates bookings and processes payments on behalf of helpers. A 15% service fee applies to all bookings made through the platform.

7. Payments and refunds

Payments are processed securely by Stripe. Subscription fees are billed monthly and are non-refundable except where required by law. For booking refunds, please contact the helper directly or email us within 48 hours of the session at contact@kindnesscommunityfoundation.com.

8. Medical disclaimer

Kind Health does not provide medical advice. The content and AI responses on this platform are for informational and guidance purposes only. They do not constitute professional medical advice, diagnosis, or treatment. Always seek the advice of your GP or other qualified health provider with any questions you may have about a medical condition. In an emergency, call 999.

9. Intellectual property

All content, trademarks, and technology on the Kind Health platform are owned by Kind Health Ltd or our licensors. You may not copy, modify, distribute, or create derivative works without our written permission. You retain ownership of content you post (such as community posts), but grant us a licence to display it on the platform.

10. Limitation of liability

To the maximum extent permitted by law, Kind Health Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may delete your account at any time from your profile settings. We may suspend or terminate your account if you breach these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately.

12. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or platform notice. Continued use of the Service after changes take effect constitutes acceptance.
